 NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

FOR TIERED PROJECTS AND PROGRAMS

 On or after November 30th, 2024 the City of Marysville will submit a request to the HUD Program Region 10 Office for the release of Community Development Block Grant Title I of the Housing and Community Development Act of 1974, to undertake the following project: 

 Tier 1 Broad Review Project/Program Title: Homage Senior Services – Minor Home Repair

Purpose: To assist low-income seniors with minor home repairs.

LocationProject sites include multiple residences throughout City of Marysville.

 Project/Program Description: Home Repair provides health related home repairs that include repairs to clogged sewers, clogged toilets, leaking sinks and faucets, leaking roofs, gutter repairs, broken furnace/heating systems and much more. Minor Home Repair also provides safety related home repairs that include installation of grab bars, handrails, secured door locks, smoke alarms and carbon monoxide detectors, door and window repairs, and installation of non- skid materials on landings and steps. Accessibility improvements include low-rise stairs and ramps to improve entry and exit from the home, when funding allows.

 Tier 2 site specific reviews will be completed for those laws and authorities not addressed in the tier 1 broad review for each address under this program when addresses become known.

 Level of Environmental Review Citation: 24 CFR Part 58.35(a)(3)(i)

 Tier 2 Site Specific Review: The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review:  

  • Flood Insurance [Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 [42 USC 4001-4128 and 42 USC 5154a]]
  • Contamination and Toxic Substances [24 CFR 50.3(i) & 58.5(i)(2)]
  • Floodplain Management [Executive Order 11988, particularly section 2(a); 24 CFR Part 55]
  • Historic Preservation [National Historic Preservation Act of 1966, particularly sections 106 & 110; 36 CFR Part 800]
  • Noise Abatement and Control [Noise Control Act of 1972, as amended by the Quiet Communities Act of 1978; 24 CFR Part 51 Subpart B]
  • Wetlands Protection [Executive Order 11990, particularly sections 2 & 5]

 Mitigation Measures/Conditions/Permits (if any): 

  • Flood Insurance: All projects in FEMA-designated Special Flood Hazard Areas (SFHAs) will be required to maintain flood insurance. Therefore, all site-specific reviews will include a Flood Insurance Rate Map (FIRM). Projects within a SFHA must also provide proof of insurance.
  • Contamination and Toxic Substances: All sites will be evaluated to determine if they are in/near a EPA Superfund National Priorities site, CERCLA List site or equivalent for State of WA, solid-waste landfill, or if any underground storage tanks exist on site. Given the small scale of the projects, which are limited to minor repairs and accessibility upgrades, little can be done to remediate for toxics or contamination within the scope of this action; however, other funding sources will be considered for cleanup efforts if it is determined to be necessary as sites are evaluated.
  • Floodplain Management: Each site will be compared to the FEMA FIRM maps to determine whether the property is within the 100-year floodway. For any proposed projects within the 100-year floodplain, a 5-step process will be completed to evaluate practicable mitigation measures.
  • Historic Preservation: Marysville does not have a historic district; however, for any home more than 45 years old or projects involving ground disturbance, SHPO will be consulted (see attached checklist).
  • Noise Abatement and Control: Each site will be evaluated for proximity to: airports (15 miles), arterial and major roadways (1,000 ft) and the BNSF railway (3,000 ft.) or any other major noise source. Noise mitigation methods appropriate to each individual project will be considered and the homeowner will be informed of other rehabilitation programs available to reduce noise level. See attached checklists for Noise Abatement and Control and Airport Noise.
  • Wetlands Protection: For each site involving expansion of the building's footprint (not anticipated, except construction of ADA access) or ground disturbance, the National Wetlands Inventory and other wetland maps and reports held by the City of Marysville will be consulted to determine if there are any possible impacts to wetlands or their buffers. If needed, a site-specific report and/or mitigation will be requested. If there is no practicable alternative to work in the wetland, the 8-Step Process will be followed.

Estimated Project Cost: $112,000

 The activity/activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR Part 58.35(a)(3)(i)An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at 501 Delta Avenue Marysville, WA 98270.  PUBLIC COMMENTS

 Any individual, group, or agency may submit written comments on the ERR to Kathryn Bird, Associate Planner at 360-363-8232All comments received by November 30th, 2024 will be considered by the City of Marysville prior to authorizing submission of a request for release of funds. 

 ENVIRONMENTAL CERTIFICATION

 The City of Marysville certifies to HUD that Jon Nehring, Certifying Officer, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Marysville to use HUD program funds. 

 OBJECTIONS TO RELEASE OF FUNDS

 HUD will accept objections to its release of fund and the City of Marysville’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Marysville; (b) the City of Marysville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/ Washington State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD’s field office at 909 1st Ave Ste 300 Seattle, WA 98104. Potential objectors should contact HUD to verify the actual last day of the objection period.
